Se confirmó la providencia proferida por el Tribunal de la referencia únicamente en lo relativo a dejar a la actora en libertad de presentar una nueva acción de tutela, lo anterior, debido a que al revisar el proceso instaurado encontró que uno de los motivos de impugnación fue la incompetencia del juez de primera instancia y que al momento de proferir esta providencia la Corte desconoce si la actora presentó una nueva acción, en consecuencia el procedimiento a seguir es poner en conocimiento de la parte afectada la falta de competencia y procurar el saneamiento.

Por las razones expuestas en esta providencia, CONFIRMASE la providencia proferida por el Tribunal Superior del Distrito Judicial de Cartagena, Sala de Familia, el 21 de junio de 1996, dentro del proceso No. T-102.357, únicamente en lo relativo a dejar a la actora en libertad de presentar una nueva acción de tutela.
